According to OSHA, Virginia operates its own worker safety and health program under a plan approved by the U.S. Department of Labor. This program provides safety and health protections to most private sector workers, as well as state and local government employees within Virginia.
The state of Virginia’s Department of Labor and Industry is in charge of the Virginia Safety and Health Plan. Most of the Virginia Occupational Safety and Health (VOSH) standards are identical to federal OSHA standards, including 29 CFR Parts 1910, 1926, and 1928 which applies by Virginia’s own terms to all employers who have employees working at places of employment within the jurisdiction of the State Plan of the Commonwealth.
While standards in Part 1910 apply to employers in the general industry, certain standards from Part 1910 also apply to the construction industry in Virginia. The following federal standards have been adopted and apply to the listed industries:
